We make reasonable efforts to ensure that product descriptions, images, specifications, prices, and availability are accurate. However, colors, components, packaging, dimensions, and other product details may vary slightly from the information displayed on the website.

We reserve the right to correct errors, update product information, change product specifications, or discontinue products without prior notice.

Advertised speed, range, charging time, climbing ability, and other performance figures are estimates or results obtained under specific testing conditions. Actual performance may vary depending on rider weight, terrain, temperature, riding mode, battery condition, maintenance, and other factors.

Unless expressly stated otherwise, performance figures are not guarantees.

4. Orders and Payment

Placing an order constitutes an offer to purchase a product from UpGoing. An order confirmation acknowledges receipt of your order but does not necessarily mean that the order has been accepted or shipped.

We may reject, limit, or cancel an order due to product availability, pricing or description errors, payment issues, suspected fraud, shipping restrictions, reseller activity, or a violation of these Terms.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method.

All prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes, shipping fees, and other charges will be displayed during checkout where required.

By submitting payment information, you represent that you are authorized to use the selected payment method.

5. Shipping, Returns, and Warranty

UpGoing products may include electric bikes, electric dirt bikes, electric motorcycles, batteries, replacement parts, and accessories.

Product classifications and legal-use requirements vary by product configuration and location. You are responsible for determining whether a product may legally be registered, licensed, insured, transported, or operated on public roads, bike lanes, sidewalks, trails, parks, or other property in your area.

Products described as intended for off-road or private-property use must not be used on public roads unless they have been legally approved, registered, and equipped for that purpose.

You are responsible for following all applicable age, helmet, licensing, registration, insurance, speed, equipment, and operating requirements.

Always read and follow the product manual, safety warnings, charging instructions, and maintenance requirements. Unauthorized modifications or the use of incompatible batteries, chargers, components, or accessories may make a product unsafe or unlawful and may affect warranty coverage.

Product names, appearance, motor ratings, speed, or marketing descriptions do not determine a product’s legal classification.

7. Intellectual Property

All content available through the Services, including the UpGoing name, logos, trademarks, product names, text, images, videos, graphics, designs, software, and website layout, is owned by or licensed to UpGoing and is protected by applicable intellectual-property laws.

You may access and use the Services only for personal, non-commercial purposes.

You may not copy, reproduce, modify, distribute, publish, sell, license, scrape, or commercially exploit website content without our prior written permission.

8. User Content

You may be able to submit reviews, photographs, videos, comments, feedback, or other content through the Services.

You represent that you own or have permission to use the content you submit and that it does not violate any law or the rights of another person.

UpGoing does not guarantee that the website will always be available, uninterrupted, secure, error-free, or free from harmful components.

Products sold by UpGoing are subject to our applicable 1-Year Limited Warranty and any rights or implied warranties that cannot legally be excluded or limited.

To the extent permitted by applicable law, any implied warranties applicable to a product may be limited in duration to the duration of the applicable written Limited Warranty.

Nothing in these Terms excludes, restricts, or modifies any warranty, right, or remedy that cannot lawfully be excluded, restricted, or modified.

12. Limitation of Liability

To the maximum extent permitted by applicable law, UpGoing and its affiliates, employees, officers, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to:

  • Improper, unsafe, or unlawful use of a product.

  • Unauthorized product modifications.

  • Third-party services or conduct.

  • Loss of data, revenue, profits, use, or goodwill.

To the maximum extent permitted by law, UpGoing’s total liability relating to a product or transaction will not exceed the amount paid to UpGoing for the product or transaction giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

13. Governing Law

These Terms and any purchases made through upgoing.com are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law principles.

Nothing in these Terms limits any mandatory consumer rights or protections available to you under applicable federal, state, or local laws in the United States.

We may update these Terms from time to time to reflect changes in our Services, business practices, or legal obligations.
